xpoca cannot guarantee that this website, our servers, or email communications associated with the use of this website are free from viruses. xpoca will not be liable for any damages of any kind resulting from the use of this website, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Display, Explanation, and Amendment of Terms of Service of Use

The ‘Site’ is committed to transparently presenting the Terms of Service (ToS) for users. Essential details, including company information such as the name, representative, business address (including an address for customer complaints), contact numbers, email address, business license number, e-commerce permit number, and the personal information manager’s name, will be prominently displayed on the main page. Prior to a user’s final agreement to these ToS, the ‘Site’ will facilitate a separate link or pop-up screen for users to verify cancellation rights, delivery responsibilities, refund conditions, and other critical information.

Amendments to the ToS will be made within legal limits, considering relevant consumer protection laws and regulations. The ‘Site’ will specify the effective date and reasons for amendments, with the information posted on the main screen seven days before the effective date. In cases where amendments are unfavorable to users, the ‘Site’ will provide a 30-day grace period for notice, clearly explaining changes in an easily understandable manner.

These amendments will apply to contracts concluded after the effective date. Contracts concluded before the effective date will remain governed by the provisions of the previous ToS. Users who have previously signed contracts and wish to adopt the amendments can communicate their intent to the ‘Site’ during the notice period.

For any information not specified in these ToS, interpretation will align with e-commerce Transaction Guidelines, Related Consumer Protection Acts by the Fair Trade Commission, and other relevant Consumer Protection Laws and the Regulation of ToS Act.

Provision & Replacement of Service

The ‘Site’ is responsible for the following duties:

1. Providing information about Goods and Services and concluding purchasing contracts.

2. Delivering Goods and Services as per the purchase contract.

3. Fulfilling other duties designated by the ‘Site.’

The ‘Site’ may replace Goods and Services outlined in future Terms of Service if they are sold out or if technical specifications are revised. The ‘Site’ will promptly announce the replacement, including the effective date, on the page where the current Goods and Services are displayed.

If replacement occurs due to technical specification changes or product unavailability, the ‘Site’ will promptly notify Users of the reason for replacement.

In such cases, the ‘Site’ will compensate for any damages incurred, unless it can prove that the event is not a result of intentional actions or negligence on its part.

Membership

Users can apply for Membership by expressing their intent to agree to these Terms of Service after completing the designated form provided by the ‘Site’ with their personal information. The ‘Site’ will register all Users applying for Membership unless the User is engaged in issues such as reapplying within three years after losing Membership, providing false information in the registration form, or causing technical difficulties according to the ‘Site’s assessment.

Membership becomes effective upon the Member’s receipt of the ‘Site’s approval. Members should update their account information through the provided methods for editing personal information.

Withdrawal from Membership & Loss of Eligibility

Members may request to withdraw from Membership at any time, and the ‘Site’ will promptly process the request. The ‘Site’ may limit or suspend Membership for various reasons, including providing false information, non-payment of liabilities, interference with other users or actions against public order and morals.

The ‘Site’ may forfeit the Membership of a Member whose Membership was suspended or limited if the same actions are repeated, or if the cause is not corrected within 30 days. Upon forfeiting Membership, all information will be canceled. The ‘Site’ will notify the Member and provide at least 30 days or more to explain the cause before cancellation.

Suspension of Service

The ‘Site’ may temporarily suspend its services for reasons such as computer and telecommunication equipment maintenance, repairs, or communication interruptions. In the event of damages caused by the suspension, the ‘Site’ will compensate users or third-party members, unless it can prove the event is not due to intentional actions or negligence.

If there is a change in business items, business abandonment, or mergers, the ‘Site’ will notify consumers and provide compensation as specified in Notification to Members or according to conditions suggested by the original ‘Site.’ If no compensation standard is provided, the ‘Site’ will compensate users with mileage, reserve in kind, or cash equivalent to the currency used at the ‘Site.’

Products or Services

We reserve the right to limit sales based on individuals, regions, or jurisdictions on a case-by-case basis.

Quantities of products or services offered may be restricted, and descriptions, pricing, and product availability are subject to change without notice. We retain the right to discontinue any product at any time.

While we strive for accurate representation of product colors and images, we cannot guarantee precise color matching on your computer monitor. Offerings are void where prohibited, and we do not guarantee that purchased products or services will meet your expectations or that Service errors will be corrected.

Resolution of Dispute

The ‘Site’ will consider and address opinions or complaints from Users, establishing a process for compensating consumer damages. User opinions or complaints will be prioritized, and if immediate resolution is not feasible, the ‘Site’ will notify the User, providing the cause and the final settlement schedule.

In the event of a dispute between the ‘Site’ and a User, the User may file for the remedy of damage, and the matter may be commissioned for arbitration by the Fair-Trade Commission or a Dispute Conciliation Services Organization selected by the City Mayor.

Jurisdiction & Governing Law

E-commerce-related lawsuits between the ‘Site’ and a User will follow the address of the ‘Site’ at the time of indictment. If no address is available, the lawsuit will fall under the exclusive jurisdiction of the district court near the ‘Site’s’ place of residence. If the ‘Site’s’ address or residence is unclear or if the ‘Site’ is a foreign entity, the lawsuit will be filed with the competent court under the Civil Procedures Code.

All e-commerce-related lawsuits between the ‘Site’ and a User will be governed by the law of the Republic of Korea.

Severability

If any provision of these Terms is deemed unlawful or unenforceable, it will be enforced to the fullest extent allowed by law. The invalid portion will be severed without affecting the validity of the remaining provisions.
